Nintendo has confirmed that the Switch’s Joy-Con controller issues are due to manufacturing variations, which have now been fixed at the factory level. 
 
This means that future Nintendo Switch consoles will not have this issue, though Nintendo has created a “simple fix” that will improve the connectivity of affected Joy-Con controllers. If Switch users suffer from this issue they can contact Nintendo and seek a free repair of their controller, provided Nintendo Support see the repair as necessary. 
 
   

     There is no design issue with the Joy-Con controllers, and no widespread proactive repair or replacement effort is underway. A manufacturing variation has resulted in wireless interference with a small number of the left Joy-Con. Moving forward this will not be an issue, as the manufacturing variation has been addressed and corrected at the factory level.

We have determined a simple fix can be made to any affected Joy-Con to improve connectivity.

There are other reasons consumers may be experiencing wireless interference. We are asking consumers to contact our customer support team so we can help them determine if a repair is necessary.

If it is, consumers can send their controller directly to Nintendo for the adjustment, free of charge, with an anticipated quick return of less than a week. Repair timing may vary by region. For help with any hardware or software questions, please visit http://support.nintendo.com.

It seems that this issue is not a “design flaw” from Nintendo, with a fix having already been implemented with their manufacturer. Future Nintendo Switch consoles will not be affected by this issue, though there will still be models at retail which will not include this fix. 

Nintendo are not planning to start an active repair and replace program for controllers that are affected by this issue, as they state that the issue only affects a minority of users, with affected users being able to contact Nintendo support to get their controllers repaired.
